Clarifying the Role of the Provost Marshal: Accurate Information Supports State of the Union Development


Comprehending the Constitutional Framework: When Civilian Courts Resume Operation, Military Tribunals Stand Down, and State Secretaries of State Validate Elections


Peace and progress flow from clear understanding. When we work together to build State of the Union Assemblies and foster relations through international business across various jurisdictions, accurate information becomes the foundation that supports everything we do. The Peacekeeping Task Force (PKTF) carries an exceptionally important responsibility within Original Jurisdiction to report accurately where international business and peace-building cooperation is concerned, particularly while State of the Union and Union State Assembly development continues to grow and relations flourish through this effort.

During a recent Weekly Coordinator Call meeting with attendees, along with the Federation Fiduciary, it was brought to our attention by several of our international service counterparts that some questionable information was briefly shared within mixed company regarding the Provost (pronounced “Provo”) Marshal and the Office of the Provost (Provo) Marshal General that appears to have been provided to the Federation Fiduciary inaccurately. This article serves as a helpful clarification to support everyone working toward the same goal: knowing well the actual role these offices serve within the constitutional process, particularly when acknowledging Ex parte Milligan.

The Office of the Provost Marshal General operates within the Department of the Army, which falls under the Department of Defense. The Provost Marshal General serves as the principal military advisor to the Secretary of the Army and Chief of Staff of the Army on policing matters. The Provost Marshal and the Office of the Provost Marshal General work together seamlessly -the Provost Marshal serves as the individual leader while the Office provides the organizational structure that enables the mission to proceed effectively.

The actual service expectation for these offices is clear and well-documented. The Office of the Provost Marshal General oversees prisoner disposition, coordinates transfers from military custody to civilian custody, maintains records of adjudications, processes FOIA requests from the Adjutant's office, and stands down military tribunal-style courts when proper American civilian courts return to full operation. The key phrase here is "full operation" - when courts are operational (and in this scenario it is labeled as American Common Law Courts in the traditional sense), meaning proper, lawful civilian courts are then fully open and functioning, then military tribunals stand down and those civilian courts resume jurisdiction.

State elections find their validation through the State Secretary of State, who currently serves in the de facto realm of State of State functions as the chief election official in 37 of the 50 organic states. The Secretary of State certifies such election results, tests, or takes note of voting/balloting equipment/processes, provides/offers guidance to local/State election officials/officers, maintains voter/elector rolls/census, certifies official/officer candidate lists, tracks and certifies ballot initiatives, and compiles election returns (for overall validity). This constitutional boundary protection lawfully and legally places proper election validation firmly within de facto, as well as de jure State, and State of State authority, not Federal military offices. The Office of the Provost Marshal General does not, and never has throughout known American history had constitutional authority to validate any elections at any level of government whatsoever.

The Peacekeeping Task Force continues its very important work which includes, but is not limited to reporting accurately when international business runs parallel, or parleys with the various jurisdictional framework is concerned and impacted. State of the Union Assembly development progresses as we build enduring relations through honest communication and clear comprehension. When we go the extra mile to report what actually exists - rather than what we might wish exists by embellishing certain items as facts - we build lasting credibility that supports everything we accomplish together.

The Ex parte Milligan process moves forward when civilian courts return to full operation. Military tribunals will then be directed to stand down systematic to where such process has been resumed under Ex parte Milligan. Civilian courts regain its superior, concurrent general jurisdiction. The Office of the Provost Marshal General coordinates the transition from military custody courts under the Uniform Code of Military Justice gives way to American Common Law civilian custody. State Secretary of State offices are those at the State of State level that validates elections. Each part serves its proper function within the constitutional framework - both Federal and State of State.

We hope this clarity goes the distance to support proper accountability in this scenario. It supports credibility. It enhances the progress we all seek. When we share accurate information, we build trust. When we build trust, we build something resilient that stands strong. And that is absolutely what we are working toward together.
